Terms of Service

1. Eligibility & Responsible Use

• You must be at least the minimum legal age for sports wagering or paid fantasy contests in your jurisdiction (typically 21 for sportsbook wagering and 18 for daily fantasy in some states). If your jurisdiction sets a higher minimum age, that higher age applies.
• You are solely responsible for ensuring your use of the Service complies with local laws and platform rules. The Service is not a sportsbook or fantasy operator and does not place bets or enter contests on your behalf.
• If you or a household member has a gambling problem, do not use the Service.

2. Projections & Disclaimers (No Advice)

• Predictions ≠ promises. Wager responsibly.
• Our models, projections, picks, probabilities, and content are provided for informational purposes only and do not constitute betting, financial, or legal advice.
• We make no guarantee of accuracy, success, winnings, profits, or future performance. You are solely responsible for your decisions.

3. Accounts, Plans, and Billing

• Accounts. You may need an account to access certain features. Keep your credentials secure and notify us of any unauthorized use.
• Subscriptions & Trials. Paid plans and any free trials are billed by our payment processor (e.g., Stripe). Plans auto-renew until canceled.
• Pricing & Taxes. Prices may change with notice. You’re responsible for applicable taxes.
• Cancellations. Cancel anytime; access continues through the current billing period.
• Refunds. Unless required by law, fees are non-refundable, including partial periods or unused features.
• Chargebacks/Fraud. We may suspend or terminate accounts with unresolved chargebacks or suspected fraud.

4. Acceptable Use

You agree not to:

• Violate laws or third-party rights;
• Scrape, spider, or harvest data except as permitted via documented APIs;
• Circumvent access controls, security, or rate limits;
• Resell, sublicense, or redistribute picks, models, or data without our written consent;
• Use the Service to promote illegal betting, match-fixing, or fraud.

We may suspend or terminate access for violations or risk.

5. Intellectual Property

• The Service—including models, code, designs, content, and data—is owned by Algobet LLC or its licensors and protected by IP laws.
• We grant you a limited, revocable, non-transferable, non-exclusive license to access the Service for personal, non-commercial use (unless your plan expressly allows commercial use).
• Do not remove proprietary notices or reverse-engineer any part of the Service.

6. User Content & Feedback

• If you submit content (e.g., comments, suggestions), you grant Algobet LLC a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display it to operate and improve the Service.
• You represent you have the rights to grant this license and your content doesn’t infringe others’ rights.

7. Third-Party Services & Links

We may reference or link to sportsbooks, odds providers, fantasy operators, or other third-party services. We are not responsible for those services; your dealings are solely between you and those third parties.

8. Disclaimers

• THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT PICKS, DATA, OR OUTPUTS ARE ACCURATE, RELIABLE, ERROR-FREE, OR WILL GENERATE PROFITS OR WINS.
• WE DO NOT WARRANT CONTINUOUS, UNINTERRUPTED AVAILABILITY OR THAT DEFECTS WILL BE CORRECTED PROMPTLY.

9. Limitation of Liability

To the maximum extent permitted by law:

• ALGOBET LLC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.
• OUR TOTAL LIABILITY FOR ANY CLAIM arising out of or relating to the Service WILL NOT EXCEED THE AMOUNTS YOU PAID TO ALGOBET LLC FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
• SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED.

10. Indemnification

You agree to defend, indemnify, and hold harmless Algobet LLC and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

11. Privacy

• See our Privacy Policy for how we collect, use, and share data (e.g., account info, analytics). By using the Service, you consent to those practices.
• We use third-party processors (e.g., Stripe, Supabase). Your data may be processed in the U.S. and other countries.

12. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time. If a material change affects paid subscribers, we’ll provide notice consistent with your plan.

13. Termination

You may stop using the Service at any time. We may suspend or terminate accounts for violations, risk, non-payment, or legal reasons. Sections intended to survive termination will survive (e.g., IP, disclaimers, liability limits, dispute resolution).

14. Governing Law; Dispute Resolution

• Governing Law. These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules.
• Arbitration & Class Action Waiver (U.S.). Any disputes will be resolved by binding arbitration on an individual basis under JAMS (or AAA) rules in New Castle County, Delaware. You and Algobet LLC waive any right to participate in a class action. You may opt out of arbitration within 30 days of first acceptance by emailing support@algobet.ai with subject “Arbitration Opt-Out.”

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with a new Effective Date. Continued use after changes constitutes acceptance.
